GENERAL TERMS AND CONDITIONS

1. Introductory provisions 

1.1 The operator of the employment agency is:

 (hereinafter referred to as the "Agency") 


1.2 These General Terms and Conditions (hereinafter referred to as the "GTC") govern the rights and obligations between the Agency, its clients (hereinafter referred to as the "Client") and persons interested in employment mediation (hereinafter referred to as the "Applicant"). 

1.3 The GTC form an integral part of every contractual relationship concluded between the Agency and the Client or Applicant. 


2. Definitions 

Agency – FeDoGas s.r.o. 

Client – ​​a natural or legal person using the Agency's services 

Applicant – a natural person interested in employment 

Candidate – an Applicant introduced to the 

Client Services – services provided by the Agency


3. Scope of services 

3.1 The Agency mainly provides: 

employment mediation 

search and selection of candidates temporary assignment of employees personnel leasing administrative and HR services 

3.2 The Agency will make reasonable professional efforts to secure suitable candidates, but does not guarantee the filling of a job position or the conclusion of an employment relationship. 

3.3 The scope of services is always agreed individually. 


4. Formation of a contractual relationship 

4.1 A contractual relationship is established by signing a contract, confirming an order or by electronic confirmation.

4.2 The order contains in particular: the title of the position, requirements for the candidate, place of work and expected start date. 

4.3 The Agency is entitled to refuse the order. 


5. Rights and obligations of the Agency 

5.1 The Agency undertakes to provide services professionally, with due care and in accordance with legal regulations. 

5.2 The Agency undertakes to maintain confidentiality regarding all facts that it learns about during cooperation. 

5.3 The Agency is not responsible for the veracity of the data provided by the Applicant. 


6. Client's Rights and Obligations 

6.1 The Client undertakes to provide the Agency with true, complete and up-to-date information. 

6.2 The Client is obliged to ensure safe working conditions at the workplace. 

6.3 The Client is obliged to pay the price of the services properly and on time. 

6.4 The Client undertakes not to employ a Candidate introduced to him by the Agency without the written consent of the Agency, within a period of 12 months from his introduction. 

6.5 In the event of a breach of point 6.4, the Client is obliged to pay the Agency a contractual penalty of EUR 5,000 for each Candidate so employed.


7. Obligations of the Applicant 

7.1 The Applicant is obliged to provide true, complete and up-to-date information. 

7.2 The Applicant is obliged to cooperate with the Agency. 

7.3 The Agency is not responsible for the Client's decision not to employ the Applicant. 


8. Price of services and payment terms 

8.1 The price of services is determined by individual agreement between the Agency and the Client. 

8.2 The Agency is entitled to issue an invoice after the service has been provided. 

8.3 Invoices are due 14 days from the date of issue. 

8.4 In the event of delay, the Agency is entitled to charge interest on delay in the amount of 0.05% per day. 


9. Liability for Damage 

9.1 The Agency is not liable for damages caused by the actions of the Candidate or employee at the Client's workplace. 

9.2 The Agency is not liable for the Client's lost profit. 

9.3 The Agency's maximum liability is limited to the amount of the paid service price. 


10. Complaints 

10.1 Complaints can be made in writing or electronically. 

10.2 The complaint must be filed no later than 7 days after the defect is discovered. 

10.3 The Agency will handle the complaint within 30 days of its receipt. 


11. Personal Data Protection 

11.1 The Agency processes personal data in accordance with applicable law and the GDPR. 

11.2 Details on the processing of personal data are provided in a separate document "Privacy Policy". 


12. Confidentiality 

12.1 The contracting parties are obliged to maintain confidentiality regarding all confidential information. 

12.2 The obligation of confidentiality continues even after the termination of the cooperation. 


13. Termination of cooperation 

13.1 The contractual relationship may be terminated by agreement, termination or withdrawal from the contract. 

13.2 The notice period is 30 days. 


14. Dispute resolution 

14.1 The contracting parties undertake to resolve disputes primarily by agreement. 

14.2 If no agreement is reached, the dispute will be resolved on a substantive and territorial basis by the competent court of the Slovak Republic according to the registered office of the Agency. 


15. Final provisions 

15.1 The Agency reserves the right to unilaterally amend these GTC. 

15.2 Amendments to the GTC shall enter into force on the date of their publication on the Agency's website.
